Terms of Use for Maksid Arabic Dictionary Website
Definitions
"Maksid" refers to the online dictionary operated by Tabiar, including its website, mobile applications, associated materials, and any related services provided by Tabiar. The term "Maksid" may also be used interchangeably with "the Service" or "the Website" throughout these Terms of Use.
Welcome to Maksid.com, a website that provides an online Arabic dictionary with a number of tools (the "Service"). By accessing or using the Service, you agree to these Terms of Use ("Terms").
1. Use of Service
The Service is provided for informational purposes only. You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates any applicable federal, state, local, or international law or regulation
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
- To impersonate or attempt to impersonate Maksid, a Maksid employee, another user, or any other person or entity
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by Maksid, may harm Maksid or users of the Service or expose them to liability
2. Intellectual Property Rights
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Maksid, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms permit you to use the Service for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:
- Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
- You may store files that are automatically cached by your Web browser for display enhancement purposes.
- You may print or download one copy of a reasonable number of pages of the Service for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

In addition to the guidelines listed in Section 4, we ask that all users of the Service conduct themselves in a respectful and appropriate manner. This includes refraining from using offensive, discriminatory, or defamatory language or behavior while using the Service.
4. User Contributions
While users are unable to edit or modify definitions, translations, or other content on the Service, we welcome and encourage users to create and share wordlists and other user-generated content. By submitting user-generated content to the Service, you represent and warrant that you have all necessary rights and permissions to share such content, and that your content does not violate the intellectual property rights or other rights of any third party. We reserve the right to remove any user-generated content that we determine, in our sole discretion, to be in violation of these guidelines or otherwise inappropriate for the Service.
The Service may allow you to upload, submit, store, send, or receive content and materials (collectively, "User Contributions") on or through the Service. By submitting User Contributions, you grant Maksid a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Contributions in all formats and distribution channels now known or hereafter devised (including in connection with the Service and Maksid's business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
You represent and warrant that you own or control all rights in and to your User Contributions and have the right to grant the license granted above to us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns. You further represent and warrant that all of your User Contributions do and will comply with these Terms.
You understand and acknowledge that you are responsible for any User Contributions you submit or contribute, and you, not Maksid, have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness.
Maksid is not responsible or liable to any third party for the content or accuracy of any User Contributions posted by you or any other user of the Service.
In order to maintain a safe and appropriate learning environment for all users, we ask that User Contributions adhere to the following guidelines:
- User Contributions should be appropriate for all ages and proficiency levels of learners.
- User Contributions should not contain any offensive, discriminatory, or defamatory language or content.
- User Contributions should not contain any inappropriate or explicit material.
- User Contributions should not contain any confidential or proprietary information.
Maksid reserves the right to remove any User Contributions that violate these guidelines or are otherwise deemed inappropriate, in our sole discretion.
5. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. Maksid makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service. You expressly agree that your use of the Service is at your sole risk.
6. Website Content and Updates
Please note that the content on Maksid, including - but not limited to - entries, definitions, translations, and examples, may be updated or modified at any time. We strive to keep our content as accurate and up-to-date as possible with a number of stages for checking and revising, but since this is human work, we cannot guarantee that all information on the website is completely error-free or current.
Additionally, please note that the examples (such as example sentences and phrases) provided on Maksid are for illustrative purposes only and are not intended to serve as sources of information. As such, they may not always be accurate, complete, or reflect the viewpoint of Maksid.
7. Limitation of Liability
Maksid shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:
- The use or inability to use the Service
- The cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the Service
- Unauthorized access to or alteration of your transmissions or data
- Statements or conduct of any third party on the Service
- Any other matter relating to the Service
8. Monitoring and Enforcement
Maksid reserves the right to monitor and enforce these guidelines and take appropriate action, including but not limited to removing any content or User Contributions that violate these guidelines, suspending or terminating access to the Service, and reporting any illegal activity to the appropriate authorities.
9. Indemnification
You agree to indemnify and hold Maksid, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns (the "Indemnified Parties") harmless from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Contributions, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.
10. Modification of Terms
Maksid reserves the right, in its sole discretion, to change, modify, add, or remove portions of these Terms at any time without notice to you. It is your responsibility to check these Terms periodically for changes. Your continued use of the Service following the posting of changes will mean that you accept and agree to the changes.
11. Termination
Maksid may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate these Terms or your account, you may simply discontinue using the Service.
12. Subscriptions
Users may have the ability to purchase a subscription to access additional features or content on the Service. Subscriptions may be offered on a monthly or yearly basis, and no refunds will be provided after the first fee is obtained.
13. User-Generated Content Ownership
All user-generated content created and shared through the Service remains the property of the user who created it. However, by submitting user-generated content to the Service, the user grants Maksid a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, modify, distribute, and display such content for any purpose in connection with the Service.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Turkiye, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to, or use of, the Service or these Terms shall be instituted in a court of competent jurisdiction in Istanbul, Turkiye.
15. Entire Agreement
These Terms and our Privacy Policy constitute the sole and entire agreement between you and Maksid with respect to the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Service.
16. Waiver and Severability
No waiver by Maksid of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Maksid to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.
